Text

(a)The department may assess a third party administrator, an insurer, or a health maintenance organization that violates section 1 of this chapter a fine of one thousand dollars ($1,000) per day for which the claims data is provided after the time frame set forth in section 1 of this chapter. A fine collected under this section shall be deposited into the payer affordability penalty fund established by IC 12-15-1-18.5.
(b)A person described in this section may appeal a fine assessed under this section in the manner prescribed by the department.
