§ 25-1-9-18 — Fitness determination of health care provider; filing complaint

(a)If the insurance commissioner forwards to the board the name of a practitioner under IC 34-18-9-4(a) (or IC 27-12-9-4(a) before its repeal), the board shall consider whether:
(1)the practitioner has become unfit to practice under section 4 of this chapter; and
(2)a complaint should be filed under IC 25-1-7-4.
(b)If the board determines that a complaint should be filed under subsection (a), the board must report to the consumer protection division whether the board will schedule the matter:
(1)for informal negotiation under IC 25-1-7-6;
(2)on the board's agenda for a vote requesting that the attorney general prosecute the matter before the board under IC 25-1-7-7; or
(3)on the board's agenda for a vote on summary suspension of the practitioner's license pending prosecution of the
