Text

(a)Except as provided in subsection (b), a person who knowingly violates this article commits a Level 5 felony.
(b)A person who knowingly violates this article commits a Level 4 felony if the person damaged by the violation is at least sixty (60) years of age.
(c)A person commits a Level 5 felony if the person knowingly makes or causes to be made in:
(1)a document filed with or sent to the commissioner or the securities division; or
(2)a proceeding, an investigation, or an examination under this article; a statement that is, at the time and in the light of the circumstances under which the statement is made, false or misleading in any material respect.
