§ 23-2-6-42 — Burden of proof; exemptions
Indiana·Title 23 BUSINESS AND OTHER ASSOCIATIONS·Art. 2 SECURITIES AND FRANCHISES·Ch. 6 Indiana Commodity Code
If a person claims an exemption in any complaint, information, indictment, writ, or proceeding under this chapter:
(1)the commissioner is not required to disprove the exemption;
and
(2)the party claiming the exemption bears the burden of proof
concerning the existence of the exemption.
