The commissioner may refer such evidence as is available concerning any violation of this chapter to the prosecuting attorney of the county in which the violation occurred, who may, with or without such a reference, institute appropriate criminal proceedings under this chapter. If evidence concerning violations of this chapter is referred to a prosecuting attorney, he shall within ninety

(90)days file with the commissioner a written statement concerning any action taken or, if no action has been taken, the reasons therefor. Formerly: Acts 1975, P.L.262, SEC.1.
