For purposes of the operation of the carbon sequestration pilot project under this chapter, the title to the pore space is vested in the person who holds in fee simple the surface interest in the land or water as identified by the property records of the county, unless another person has been explicitly conveyed, excepted, or reserved through a recorded conveyance document a right to use the pore space in a manner inconsistent with the carbon sequestration pilot project.
