Text
(a)The department may assess a civil
penalty of not more than ten thousand dollars ($10,000) against an
owner or operator who:
(1)violates; or
(2)fails to comply with an order of the division in relation to;
section 3, 4, or 4.2 of this chapter.
(b)An owner or operator who knowingly or intentionally:
(1)violates; or
(2)fails to comply with an order of the division in relation to;
section 3, 4, or 4.2 of this chapter commits a Level 6 felony if the
violation or failure to comply relates to the operation of a Class II well.
(c)A civil penalty assessed under this section shall be deposited in
the oil and gas environmental fund established by IC 14-37-10-2.
