§ 14-37-7-9 — Violations

Indiana·Art. 37 OIL AND GAS·Ch. 7 Drilling
(a)The department may assess a civil penalty of not more than ten thousand dollars ($10,000) against an owner or operator who:
(1)violates section 4 or 7 of this chapter; or
(2)fails to comply with an order of the division under section 3.5 or 4 of this chapter.
(b)An owner or operator who knowingly or intentionally:
(1)violates section 4 or 7 of this chapter; or
(2)fails to comply with an order of the division under section 3.5 or 4 of this chapter; commits a Level 6 felony if the violation or failure to comply relates to the operation of a Class II well.
(c)A civil penalty assessed under this section shall be deposited in the oil and gas environmental fund established by IC 14-37-10-2.
