§ 14-36-1-28 — Charge against bond; release of bond; refund of fees

(a) Upon receipt of the operator's affected
area report the director shall charge against the surety bonds or other
securities on deposit in connection with the operation covered by the
report the amount required by section 22 of this chapter for each acre
of land in the area of land affected by the operation within the time
covered by the report. The director shall issue to the operator and the
director's surety a release of any parts of the surety bonds or other
security on deposit in connection with the operation against which a
charge has not been made.
(b) If the report shows that the number of acres of land comprising
the area of land affected is smaller than the number of acres of land for
which the operator has paid to the director a permit fee in connection
with the permit authorizing the operation covered by the report, the
operator is entitled to a refund in the amount of the fees paid for acres
not affected.
