Text

5. The:

(1)finding required by section 7(a)(6) of this chapter; and
(2)prohibition on the issuance of a permit in section 8 of this chapter; do not apply to a violation resulting from an unanticipated event or condition at a surface coal mining operation on lands eligible for remining under a permit held by the applicant.
