§ 14-34-3-14 — Coordination with other federal act requirements

Indiana·Art. 34 SURFACE COAL MINING AND RECLAMATION·Ch. 3 Permit Requirements

The director shall, to avoid duplication, provide for the coordination of review and issuance of permits for surface coal mining and reclamation operations with applicable requirements of the following:

(1)The federal Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.).
(2)The federal Fish and Wildlife Coordination Act (16 U.S.C. 661 through 666c).
(3)The federal Migratory Bird Treaty Act of 1918 (16 U.S.C. 703 through 711).
(4)The National Historic Preservation Act (16 U.S.C. 470 et seq.).
(5)The federal Bald Eagle Protection Act (16 U.S.C. 668a). [Pre-1995 Recodification Citation: 13-4.1-3-6.]
