§ 14-33-8-4 — Damages; eminent domain
If the board of appraisers has the function of
determining damages, the board of directors may continue to make
settlement directly with the persons who own or have an interest in all
or any real property needed by the district. The board of directors also
may acquire any needed real property or easement by eminent domain
proceedings according to statute.
