§ 14-33-20-10 — Commission's findings after hearing
(a)The commission shall, after hearing the
evidence introduced at the hearing under section 8 of this chapter, enter
a finding that the convenience and necessity of the public proposed to
be served in the area in which the additional users are located:
(1)will; or
(2)will not;
be served by the district.
(b)If the finding is in the affirmative, the commission shall enter an
order granting territorial authority for the area. The district shall attach
a copy of the order to:
(1)the district plan; or
(2)a part of, an amendment to, or the implementation of the
district plan;
before the district plan is submitted for approval.
(c)If the finding is in the negative, the commission shall enter an
order denying the approval to serve the additional users in the area.
