This chapter applies if the board determines at the time of the adoption of the district plan that the characteristics of the district are such that the district plan can best be implemented in certain parts by the development of works of improvement that are:

(1)of benefit solely to abutting or proximate properties in the district; and
(2)not of benefit to all the property in the district. [Pre-1995 Recodification Citation: 13-3-3-86(a) part.]
