§ 14-28-1-27 — Contaminants in lakes or floodways prohibited
Indiana·Art. 28 FLOOD CONTROL
(a)Except as provided in subsection (b), this
section does not apply to the following:
(1)A person using chemicals in a normal manner in the
production of agricultural products.
(2)A person acting in accordance with an appropriate permit
issued by the director.
(3)A person acting in accordance with a permit issued by the
department of environmental management under water pollution
control laws (as defined in IC 13-11-2-261) or environmental
management laws (as defined in IC 13-11-2-71).
(b)This section applies to the permitting requirements set forth in
the following:
(1)Section 22 of this chapter.
(2)IC 14-26-2.
(c)A person may not put, throw, dump, or leave a contaminant,
garbage, or solid waste:
(1)in, upon, or within fifteen (15) feet of a lake; or
(2)in or upon a floodway.
