§ 14-28-1-21 — Nuisance abatement
Indiana·Art. 28 FLOOD CONTROL
A structure, an obstruction, a deposit, or an excavation described in section 20(2) of this chapter is a public nuisance. The director may commence, maintain, and prosecute an appropriate action to enjoin or abate a nuisance, including the following:
(1)Any of the nuisances described in section 20(2) of this
chapter.
(2)Any other nuisance that:
(A)adversely affects flood control or the safety of life or
property; or
(B)is unreasonably detrimental to fish, wildlife, or botanical
resources.
