§ 14-27-7-2 — Maintenance and repair

Indiana·Art. 27 LEVEES, DAMS, AND DRAINAGE·Ch. 7 Regulation of Levees, Dikes, and Floodwalls

The owner of a levee, dike, or floodwall and appurtenant works shall maintain and keep the structures and appurtenant works in the state of repair and operating condition required by the following:

(1)The exercise of prudence.
(2)Due regard for life or property.
(3)The application of sound and accepted engineering principles. [Pre-1995 Recodification Citation: 13-2-20-2.]
