Text
If a person who is assessed is damaged by
reason of the default and failure of the contractor to complete the work
within the limit, the contractor in default is liable on the bond to the
person damaged to the full extent of the damages. The damages may be
recovered in a court with jurisdiction in a suit or an action on the bond
by the state on the relation of the person damaged for the use of the
person or party injured.
