§ 14-26-8-22 — County surveyor

Indiana·Art. 26 LAKES AND RESERVOIRS·Ch. 8 Lakes; Changes in Levels
(a)The county surveyor shall estimate the cost of the project and assess the benefits or damages to all affected landowners, each county in which the lake lies, and the department if:
(1)the petition is a joint petition between the owners of land abutting or within one-fourth (1/4) mile of the shoreline or water line of the lake and the county or the department; or
(2)the petition has been filed separately or jointly by the department or the county.
(b)If the petition was filed only by the landowners abutting or within one-fourth (1/4) mile of the shoreline or water line of the lake, the county and the department may not be assessed. [Pre-1995 Recodification Citation: 13-2-18-7 part.]
