§ 14-15-4-4 — Violations

Indiana·Art. 15 REGULATION OF WATER RECREATION·Ch. 4 Watercraft Accidents

A person who knowingly or intentionally violates section 1, 2, or 3 of this chapter commits a Class C misdemeanor. However, the offense is:

(1)a Class A misdemeanor if the accident or collision results in an injury to a person;
(2)a Level 6 felony if:
(A)the accident or collision results in serious bodily injury to a person; or
(B)within the five (5) years preceding the commission of the offense, the person had a previous conviction of any of the offenses listed in IC 9-30-10-4(a), IC 35-46-9-6, or IC 14-15-8-8 (before its repeal); or
(3)a Level 5 felony if the accident or collision results in the death of a person. [Pre-1995 Recodification Citation: 14-1-1-59 part.]
