(a)The secretary is the ultimate authority for
Medicaid applicant and eligibility appeals under IC 4-15-10.5 and IC 4-21.5 for purposes of the operation of the division and the programs
of the division.
(b)The secretary may delegate an individual to serve as the ultimate
authority.
