5.
(a)The office may not reimburse a
nursing facility provider for reserving a bed for a Medicaid recipient
when the Medicaid recipient is not present in the nursing facility due
to a hospital stay or leave of absence for therapeutic reasons.
(b)Not later than September 30, 2011, the office shall submit a state
Medicaid plan amendment to the federal Centers for Medicare and
Medicaid Services to implement this section.
