Text
If:
(1)the division determines that a recipient possessed income or
property in excess of the amount reported; and
(2)it is shown that supplemental assistance was obtained
fraudulently;
the total amount of the supplemental assistance plus a penalty of twenty
percent (20%) may be recovered by the division as a preferred claim
from the estate of the recipient or in an action brought against the
recipient while living.
