Text
(a)The board shall be given the opportunity
to review and recommend changes to a proposed rule concerning the
community and home options to institutional care for the elderly and
disabled program under IC 12-10-10 for:
(1)elderly individuals; or
(2)individuals with disabilities;
before the proposed rule may be published in the Indiana Register. The
proposed rule must be distributed to the board at least one (1) month
before the board's next regularly scheduled meeting.
(b)If the proposing agency fails to give the board the opportunity to
review and recommend changes to a proposed rule described in
subsection (a), the rule:
(1)is void; and
(2)must be withdrawn by the proposing agency.
