Text

An officer or enlisted person in active service of the state shall be paid the greater of:

(1)the sum equivalent to the pay and allowances received by officers and enlisted men of the same rank or grade in the service of the armed forces of the United States; or
(2)the sum per day equal to twelve (12) times the hourly federal minimum wage in effect at the time of active service. However, with the approval of the budget committee, the adjutant general may adjust the pay of an officer or enlisted person to meet the pay and allowance adjustments of officers and enlisted persons of the same rank or grade for service in the armed forces of the United States.
