Text

(a)In making an inquiry or conducting a hearing the Secretary or Board may require the person under review to:
(1)Submit to a medical examination by a medical examiner of the person's choice who is acceptable to the Secretary or Board.
(2)Submit to a medical examination by an impartial medical examiner after the person has submitted information from that person's own medical examiner.
(3)Consent to make available to the Secretary or Board all medical records pertaining to the reported conditions that may be necessary to aid the Board in formulating its findings and recommendations.
(b)Any person under review who refuses to submit to an examination or to consent to provide information, or both, shall as a matter of law be considered unqualified to operate a motor vehicle until the indi
