(Text of Section before amendment by P.A. 104-458 ) Sec. 17. Penalties. (a) Any person operating any facility in violation of Section 8 shall be subject to a civil penalty not to exceed $100,000 per day of violation. (b) Any person failing to pay the fees provided for in Section 13 shall be liable to a civil penalty not to exceed 4 times the amount of the fees not paid. (c) At the request of the Agency, the civil penalties shall be recovered in an action brought by the Attorney General on behalf of the State in the circuit court in which the violation occurred. All amounts collected from fines under this Section shall be deposited into the Low-Level Radioactive Waste Facility Development and Operation Fund. (Source: P.A. 104-2, eff. 6-16-25.)
