§ 67-4213 — AREAS CONSTITUTING STATE PARKS — EXCEPTIONS
Any and all other areas of land within the state of Idaho, except roadside picnic areas, which are donated to, and used by, the state of Idaho for public, outdoor recreational purposes, which are acquired, and used, by the state of Idaho for such purposes or which, being state property, are set aside, and used, for such purposes are hereby declared to constitute Idaho state parks and are hereby placed under the jurisdiction and control of the park and recreation board of the department of parks and recreation of the state of Idaho. Provided, however, that this section shall not be interpreted as depriving the division of highways of the state of Idaho transportation department of any existing authority granted to said division of highways by any laws of the state of Idaho.
