§ 42-4003 — PERMITS — APPLICATION — FEE — EXCEPTIONS

Idaho·Title 42 IRRIGATION AND DRAINAGE — WATER RIGHTS AND RECLAMATION·Ch. 40 GEOTHERMAL RESOURCES ACT
(1)Any person who, as owner or operator, proposes to construct a well or to alter a well or to construct or to alter an injection well shall first apply to the director for a geothermal resource well permit, except as provided in subsection (2) of this section.
(2)The use of ground water classified as a geothermal resource or material medium for the development and operation of oil and gas wells permitted under section 47-316, Idaho Code, shall not be subject to the provisions of this chapter.
