§ 41-4014 — TRUSTEES — ADMINISTRATORS — BONDING

Idaho·Title 41 INSURANCE·Ch. 40 SELF-FUNDED HEALTH CARE PLANS
(1)Either an individual or a corporation or other legal entity may be a trustee of the trust fund. Any person acting as a trustee is a fiduciary acting on behalf of the beneficiaries of the plan and the trust fund in such capacity. An individual, firm, corporation or other legal entity may be an administrator of a plan.
(2)An employer participant in the plan shall be neither a trustee nor the administrator. A postsecondary educational institution as a plan sponsor of a self-funded plan shall be neither a trustee nor an administrator of such plan. However, this subsection shall not prohibit an individual who is otherwise an employee of such an employer or a postsecondary educational institution from being trustee or administrator.
(3)The trustee shall obtain a fidelity bond, or coverage
