§ 34-2306 — DIFFERENCE REVEALED BY RECOUNT — CANDIDATE RELIEVED OF COSTS

Idaho·Title 34 ELECTIONS·Ch. 23 RECOUNT OF BALLOTS
If the results of the recount indicate a difference, which if projected across all the precincts of the office in question would change the result of the election in favor of the candidate requesting the recount or change in the measure being recounted, then the cost of such recount shall be borne by the county or state and the sums of money theretofore paid for the recount shall be returned to the candidate or person who requested the recount of a ballot measure. In order to be relieved of the costs of the recount, the candidate or person must request that at least twenty (20) precincts containing not less than five thousand (5,000) votes cast be recounted if for a federal or state office or measure, or five (5) precincts containing not less than one thousand two hundred fifty (1,250) vot
