Whenever a permit has been granted as provided in section 461A.70 and the commission
finds that the municipality or corporation owning such permit cannot acquire at a reasonable
costanynecessarylandorinteresttherein,thecommission,withtheapprovaloftheexecutive
council, may condemn such land or interest therein as provided in chapter 6B. However, such
condemnationshallbelimitedtolandandintereststhereinwhichwillbepermanentlysubject
to and available for free public access and use, as provided in section 461A.71, or which will
be required for a dam or other facilities necessary for the water recreational area. All costs of
such condemnation, including all costs occasioned by appeal as set out in section 6B.33, and
including the award and compensation for such land or interest therein, shall be
