Thecommissionmaygrantsuchpermitinwholeorinpartuponsuchterms,conditions,and
restrictions as may be determined by the commission to be just and proper and in the public
interest. However,beforeanypermitshallbegrantedtoanysuchmunicipalityorcorporation,
the commission shall, after public hearing as provided in this subchapter, determine whether
the water recreational area will be in the interests of the public health and welfare and an
affirmativefindingtosucheffectshallbeaconditionprecedenttothegrantingofsuchpermit.
