Text
1.An administrative action to recover an overpayment to a provider shall be commenced
within five years of the date the overpayment was incurred. For the purposes of this
subsection, “incurred” means the date the medical assistance claim was paid, or the date any
applicable reconciliation was completed, whichever is later.
2.An administrative action to impose a sanction related to an overpayment to a provider
shall be commenced within five years of the date the conduct underlying the sanction
concluded, or the director discovered such conduct, whichever is later.
