Whenitappearsduringthecourseofanyhearingorproceedingthatsomeactionorremedy other than those indicated by the application or pleading is appropriate, the court, with the consent of all necessary parties, may proceed to hear and determine the additional or other issues as though originally properly sought and pleaded.
