mental health institute. 1. Admission or transfer pursuant to section 222.7 to a state mental health institute of a person with a diagnosis of an intellectual disability, as defined in section 4.1, shall only occur under the following conditions: a. If all of the following requirements are met:
(1)Thepersonhasbeendeterminedbythestatementalhealthinstitutetomeetadmission
criteria for inpatient psychiatric care.
(2)The state mental health institute has determined the person will benefit from
psychiatric treatment or from some other specific program available at the state mental
health institute.
(3)There is sufficient capacity available at the state mental health institute to support the
needs of the person.
b. If determined appropriate for the person at the sole discretion of the director
