Text
1.A person shall not engage in a surface coal mining operation without first obtaining
a license from the division. Licenses shall be issued upon application submitted on a form
provided by the division and accompanied by a fee of fifty dollars. An applicant shall furnish
on the form information necessary to identify the applicant. Licenses expire on December
31 following the date of issuance and shall be renewed by the division upon application
submitted within thirty days prior to the expiration date and accompanied by a fee of ten
dollars.
2.The division may commence proceedings to suspend, revoke, or refuse to renew a
license of a licensee for repeated or willful violation of any of the provisions of this chapter
or of the federal Coal Mine Health and Safety Act of 1969, 30 U.S.C. §8
