The commissioner or his or her designee is authorized to consider appeals of initial decisions of the department to correct errors made by the department in approving or denying any claim filed pursuant to this article upon a written request for formal review. The commissioner or his or her designee may modify or override the initial decision of the department upon a showing of an error of material fact or an abuse of discretion. The department shall be authorized to promulgate rules and regulations regarding the process and procedure for requests for formal review and appeal of initial decisions of the department.
