Text

For the purposes of this chapter, the term:

(1)“Applicant” means a person who submits an application to participate in the Voluntary Cleanup Program established by § 8-633.01 . (1A) “Bona fide prospective purchaser” means a person, or tenant of a person, who acquires ownership of a facility after June 13, 2001 and establishes by a preponderance of the evidence that:
(A)All disposal of hazardous substances at the facility occurred before the person acquired the facility;
(B)The person undertook, at the time of acquisition, all appropriate inquiry into the previous ownership and uses of the property consistent with good commercial or customary practice in an effort to minimize liability, taking into account any specialized knowledge or experience on the part of the person, the rel
