Text

(a)Any allegation of professional negligence, misconduct, or misidentification or other testing error that occurs in the provision of forensic science services or public health laboratory services at the Department shall be:
(1)Reported immediately to the Board; and
(2)Investigated promptly by the Director, in accordance with the Department’s quality assurance program and the requirements of the Department’s accreditation.
(1)An allegation that the Director determines is credible and substantial and that may substantially affect the integrity of the results of forensic analysis conducted by the Department shall be investigated by an evaluator, external to the Department, who shall be selected by the Director.
