Text

(a)No person, firm or corporation shall advertise, falsely label, sell or offer for sale any eggs which do not conform to the provisions of this part.
(b)The sale of:
(1)Inedible or adulterated eggs, as defined under the federal Food, Drug and Cosmetic Act, or the federal Egg Products Inspection Act, as amended from time to time, or (2) incubated eggs is prohibited, except that incubated eggs may be sold as commercial feed or for other commercial purposes other than human consumption, provided such incubated eggs shall be broken and denatured on the premises where incubated, in a manner approved by the Commissioner of Agriculture or the commissioner's designated agent.

P.A. 03-6 replaced separate Commissioners of Agriculture and Consumer Protection with single Commissioner of Agriculture and Consumer Protection, effective July 1, 2004; P.A. 04-189 repealed Sec. 146 of June 30 Sp. Sess. P.A. 03-6, thereby reversing the merger of the Departments of Agriculture and Consumer Protection, effective June 1, 2004; P.A. 13-241 amended Subsec. (a) by replacing provision re standards for quality and size for consumer grades established by commissioner with provision re conforming with provisions of part and amended Subsec. (b) by making technical changes, adding reference to adulterated eggs and federal Egg Products Inspection Act and replacing reference to Commissioner of Consumer Protection with reference to Commissioner of Agriculture or commissioner's designated agent, effective July 2, 2013.
