Text

(1)The director may revise the terms and conditions of a permit if:
(a)The operator is first given notice and a reasonable opportunity for a hearing on the need for a revision; and
(b)It appears to the director that a revision is necessary to protect the health or property of any person or to protect the environment.
(2)If it appears to the director that an emergency situation exists or is impending which could endanger life, property, or the environment, the director may, without prior notice or a hearing, immediately modify the conditions of a permit or order temporary suspension of the permit on the director's own order. The issuance of such order shall include notice of a hearing to be held within ten days thereafter on the question of permanently modifying the condition
