Text
Any person who
proposes to engage in surface coal mining operations may, prior to making an
application for a permit under this article, request that the board give an informal
opinion on whether or not the area of land to be affected by such proposed
operations is in, or adjacent to, an alluvial valley floor. Any such informal opinion
shall be based upon sound scientific data, shall be in writing, and shall be advisory
in nature.
