Text

(1)The commissioner shall adopt and may amend and repeal rules for acceptance of persons into the substance use disorder treatment program, considering available treatment resources and facilities, for the purpose of early and effective treatment of persons with substance use disorders, persons intoxicated by alcohol, and persons under the influence of drugs. In establishing the rules, the following standards guide the commissioner:
(a)If possible a patient shall be treated on a voluntary rather than an involuntary basis.
(b)Qualified staff shall assess the proper level of care for the person pursuant to rules adopted by the commissioner and make a referral for placement.
(c)A person must not be denied treatment solely because the person has withdrawn from treatment against
