Text
(1)This section shall only
apply to Title IV-D cases under the federal Social Security Act where the
delegate child support enforcement unit is providing support enforcement services
pursuant to section 26-13-106 and has responsibility to collect the required support
obligation for the month.
(2)Notwithstanding any provision in the Colorado rules of civil procedure to
the contrary, any amounts collected by the delegate child support enforcement
agency, except for federal income tax refund offsets, shall be allocated and
distributed first to satisfy the required support obligation for the month in which the
collection was received, except when the payment is distributed to pay the fee
required by section 26-13-106 (4). In cases where some portion of an amount
