(1)If the Indian child's parent, Indian
custodian, or tribe provides notice to the court and the parties in writing or orally on
the record that the Indian child's parent, Indian custodian, or tribe is pursuing a
tribal customary adoption as a resolution to the child custody proceeding, the
Indian child's parent, Indian custodian, or tribe must secure a motion to transfer the
case to tribal court pursuant to section 19-1.2-118 within sixty-three days after
receiving the notice. If the Indian child's parent, Indian custodian, or tribe does not
secure a motion to transfer the case within sixty-three days, the court may consider
other permanency or placement options pursuant to this article 1.2 as a resolution
