(1)If there is reason to know that a child who is the subject of a child custody proceeding is an Indian child:

(a)The court shall appoint counsel to represent the Indian child in accordance with applicable law; and

(b)The court shall appoint counsel to represent the Indian child's parent or Indian custodian pursuant to section 19-3-202 if the parent or Indian custodian is a respondent in a dependency and neglect action brought pursuant to article 3 of this title 19. In any removal, placement, or termination of parental rights proceeding, outside of a dependency and neglect proceeding, in which the court determines that an Indian child's parent or Indian custodian is indigent, the court shall appoint counsel to the Indian child's parent or Indian custodian through the office o
