It is a civil infraction for any
person engaged in the publication of any newspaper, magazine, periodical, or other
advertising medium published in the state of Colorado or for any employee of any
such publisher knowingly to make any statement concerning the circulation of the
newspaper, magazine, periodical, or other advertising medium which is untrue or
misleading where such publisher fixes his charges for advertising space in the
publication on the amount of its circulation.
