§ 13-55-105 — Court enters order or judgment

Upon such hearing, the court
shall summarily try and determine the question as to whether or not the property, or
any part thereof, so levied upon, seized, and taken into possession by the officer
making such levy, as set forth in said written claim of exemption, is exempt and
shall enter an order or judgment setting forth the determination of the court. If any
of said property is found to be exempt, the court shall order the sheriff or other
officer to return such property so found to be exempt to the defendant within forty-eight hours, unless same is ordered sold as provided in section 13-55-109.
