Text
(1)All moneys in the possession
of the clerk of any county court, subject to the provisions of section 13-3-104, as
unearned fees of the clerk or judge of such court, that remain in possession of said
clerk for a period of two years after the final determination of the cause or
proceeding in which such fees were collected shall be paid over by the clerk into
the state general fund, except as otherwise provided in subsection (2) of this
section.
(2)On and after July 1, 2010, all fees required to be paid over by the clerk into
the state general fund pursuant to subsection (1) of this section shall be
transmitted to the state treasurer for deposit in the judicial stabilization cash fund
created in section 13-32-101 (6).
